按照《电动自行车安全技术规范》和《电动摩托车和电动轻便摩托车安全要求》的划分，符合“时速25公里以内、具备脚踏、功率不超过400瓦”等指标的电动车属于非机动车电动自行车；超出这一标准的车辆，则被纳入机动车体系，按功率大小，进而分为电动轻便摩托车或电动摩托车管理。其中，大功率的电动摩托车时速最高可超过50公里。
